The Commonhold and Leasehold Reform Act 2002 gives leaseholders the statutory right to take over responsibility for the management of their development from the landlord.

In summary, to achieve this it is necessary that the majority of leaseholders in a block of flats create and then become members of a ‘Right To Manage’ (“RTM”) Management Company and serve appropriate Notice on the landlord of their intention to take over the management of their development.

Although the process in itself is not unduly complicated, it does need to be properly understood, particularly by those individuals intending to act as directors of the RTM company, and there are certain technical pitfalls that need to be avoided if one is to succeed.
